Terms of Service

The agreement that applies whenever you use Tutorio - the website, the apps, courses, practice, live lessons, classes and Rio.

  • You can browse and practise on many courses without an account; some features need one.
  • Accounts are for people aged 13 and over. Younger learners use Tutorio through a parent, school or tutor.
  • Tutors and organisations who teach on Tutorio also agree to the Tutoring & Live Lessons Terms.
  • Course content is ours or our licensors'. Your own notes, answers and uploads stay yours.
  • We do not sell your data. Our Privacy Policy explains exactly what we collect and why.
  • Consumer purchases come with the refund rights set out in our Refunds & Cancellations policy.
  • These terms are governed by the law of England and Wales.

These Terms of Service (the "Terms") are a legal agreement between you and Tutorio Ltd, a company registered in England and Wales (company number 14962372) whose registered office is at Unit 82a James Carter Road, Mildenhall, Bury St. Edmunds, England, IP28 7DE ("Tutorio", "we", "us"). They govern your use of the Tutorio website at tutorio.app, the Tutorio iOS and Android apps, the tutor workspace, live lessons, Rio, our APIs and every other product or service we make available (together, the "Service").

Please read them carefully. By creating an account, joining a class, or otherwise using the Service you agree to be bound by these Terms and by the policies they incorporate. If you do not agree, you must not use the Service.

Who these Terms apply to

Tutorio is used by several kinds of people, and some sections apply differently depending on who you are:

  • Learners - anyone studying on Tutorio, whether independently, through a tutor, or through a school or organisation.
  • Parents and guardians - adults who create, supervise or pay for a learner's use of the Service.
  • Tutors - people who use the tutor workspace to teach learners, run classes and live lessons, set assignments and reviews, and view results. Tutors also agree to our Tutoring & Live Lessons Terms.
  • Organisations - schools, colleges, councils, agencies and other bodies that use Tutorio across many staff and learners. Organisations also agree to our Schools & Organisations Agreement, which takes precedence over these Terms where the two conflict.

If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

Policies that form part of these Terms

The following policies are incorporated into and form part of these Terms. Where they are more specific than these Terms, they take precedence for the matters they cover:

Eligibility and age

Much of Tutorio can be used without an account. To create an account you must be at least 13 years old. If you are 13 to 17 you confirm that a parent or guardian has reviewed these Terms and agrees to them on your behalf.

Learners under 13 may only use Tutorio through an account or class managed by a parent, guardian, tutor or organisation that has agreed to these Terms and is responsible for supervising that use. We apply the additional protections described in Children's Privacy & Parents to every learner we know or reasonably believe to be under 18.

You must not use the Service if you have previously been suspended or removed from it, or if doing so is prohibited by law where you live.

Your account

  1. You must give us accurate information when you register and keep it up to date.
  2. You are responsible for everything that happens under your account. Keep your password confidential and do not share your account. Tell us immediately at [email protected] if you believe it has been compromised.
  3. You may sign in with Apple or Google. Those providers' terms apply to your use of their sign-in services.
  4. We may require a minimum password strength, periodic password changes, or additional verification, and may lock an account after repeated failed sign-in attempts to protect it.
  5. Sign-ins, sign-outs, password changes and administrative changes to accounts are recorded in a security audit trail as described in our Privacy Policy.
  6. Accounts are personal. Tutors and organisations must not create accounts on behalf of learners without the appropriate authority and consents described in our Children's Privacy & Parents policy.

The Service

Tutorio provides, among other things:

  • Courses and practice - structured content aligned to qualifications and exam boards, with interactive questions, marking, notes, saved items, streaks and progress tracking.
  • Tutoring tools - a workspace where tutors build and adapt courses, deliver lessons, run live lessons in which learners answer in real time, set assignments and reviews, run screening tests, monitor answers and view results.
  • Classes and organisations - join links, QR codes and codes that connect learners with tutors and organisations, plus shared course libraries for colleagues within an organisation.
  • Rio and AI features - an AI study companion and AI-assisted drafting, marking and feedback, as described in our AI Transparency Statement.
  • Notifications - email, SMS, push notifications, home-screen widgets and live activities that keep learners and tutors informed, subject to your notification preferences.
  • Purchases - individual courses, bundles, passes, licences and AI credits, on the web and through the Apple App Store and Google Play.

We are constantly improving Tutorio and may add, change, suspend or withdraw features. Where a change materially reduces something you have paid for, our Refunds & Cancellations policy explains your options.

Free use, trials and beta features

Parts of the Service are free, and we may offer trials, promotional access or beta features. Free and beta features are provided "as available", may be limited, changed or withdrawn at any time, and may behave differently from our released features. We will tell you when something is in beta.

Purchases, pricing and payment

  1. Prices are shown before you pay and include UK VAT where it applies. Prices may change, but changes do not affect purchases you have already made or the current term of a subscription.
  2. One-off purchases (courses, bundles, AI credits, licences) are charged in full at the point of purchase. Subscriptions and passes renew automatically at the end of each billing period until cancelled.
  3. Purchases made through the Apple App Store or Google Play are processed by Apple or Google under their terms; cancellations and refunds for those purchases are handled through them.
  4. Purchases made on the web are processed by our payment providers. We do not store full card numbers.
  5. AI features consume AI credits. Credits included with a plan reset each period and do not carry over unless we say otherwise; purchased credits are consumed in the order described at checkout. Credits have no cash value and are not transferable.
  6. Licences and access issued to you by a tutor, school or organisation belong to that organisation's arrangement with us and may end when your relationship with them ends.
  7. If a payment fails or is reversed we may suspend the related access until it is resolved.

Your statutory cancellation and refund rights, and our own goodwill policy, are set out in Refunds & Cancellations.

Content and intellectual property

Our content

The Service and everything in it - courses, questions, mark schemes, explanations, images, video, software, designs, the Rio character, the Tutorio name and logo and all associated intellectual property - belongs to Tutorio or our licensors and is protected by copyright, trade mark and other laws. "Tutorio" is a registered UK trade mark (UK00003931689).

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own learning or, if you are a tutor or organisation, for teaching the learners you are connected with on Tutorio. You must not copy, reproduce, scrape, sell, redistribute, publicly display, make derivative works from, or otherwise exploit our content outside the Service, except for the limited printing or downloading of material for personal study or classroom use where the Service provides that feature.

Your content

You keep ownership of anything you create or upload - notes, answers, drawings, messages, and courses and questions you write as a tutor ("Your Content"). You grant Tutorio a worldwide, royalty-free licence to host, store, reproduce, adapt, display and transmit Your Content solely as needed to operate, secure, support and improve the Service, and to share it with the people you choose to share it with (for example, the learners in your class or colleagues in your organisation). This licence ends when you delete Your Content or your account, except to the extent it has been shared with others, is held in backups for a limited period, or we must keep it by law.

You are responsible for Your Content. You confirm that you have the rights needed to upload it and that it complies with our Content & Community Guidelines. We may remove or restrict content that breaches those guidelines or the law.

Third-party content

The Service may embed or link to content from third parties such as YouTube. That content is subject to the third party's own terms (for YouTube, the YouTube Terms of Service) and we are not responsible for it.

Feedback

If you send us ideas or suggestions we may use them without any obligation to you.

AI features

Some features use artificial intelligence, including drafting course content, marking written answers against a mark scheme, generating feedback and powering Rio. AI output can be wrong, incomplete or inappropriate. It is provided to assist, not replace, learners and tutors: tutors remain responsible for what they publish to learners, and no decision with a legal or similarly significant effect on a learner is made by AI alone. Our AI Transparency Statement describes the features, the data involved and the safeguards in detail, and forms part of these Terms.

Acceptable use

You must use the Service lawfully, respectfully and only for its intended purposes. Our Acceptable Use Policy lists prohibited behaviour in detail. In short, you must not: misuse or attempt to gain unauthorised access to the Service or other users' accounts; scrape or bulk-download content; cheat, or help others cheat, in assessments; harass, bully or endanger anyone; upload unlawful or harmful content; or circumvent security, payment or usage limits.

Classes, tutors and organisations

  1. When you join a class, the tutor and, where applicable, their organisation can see your name, progress, answers, results and activity for that class, and can message or notify you through the Service. You can leave a class at any time from the Service.
  2. Tutors are independent of Tutorio unless we say otherwise. We provide the platform; we do not employ tutors, set their fees, or guarantee their qualifications, availability or results. Any arrangement about fees for tutoring is between you and the tutor or organisation, unless you purchase it from us directly.
  3. Organisations may manage the accounts of their staff and learners, including disabling access when someone leaves.
  4. We apply the Safeguarding Policy to all interactions between adults and learners on the Service.

Communications

We will send you service messages (for example, receipts, security alerts, class invitations, assignment reminders and live lesson notifications) by email, SMS, push notification or in-app notice. You can control most notifications in your settings; some security and legal notices cannot be switched off while you have an account. Marketing emails are only sent where you have agreed to them and always include an unsubscribe link.

Privacy

Our Privacy Policy explains what personal data we collect, why, who we share it with, how long we keep it and the rights you have. We comply with the UK GDPR and the Data Protection Act 2018. We never sell personal data.

Suspension and termination

By you

You can stop using Tutorio at any time and can delete your account from your settings or by following Your Data Rights & Account Deletion.

By us

We may suspend or terminate your access, or remove content, with or without notice, if we reasonably believe that you have breached these Terms or any incorporated policy, that your use poses a risk to other users, learners' safety or the Service, or where the law requires it. Where practical we will tell you why and give you the chance to respond. If we terminate for a serious breach you will not be entitled to a refund; otherwise our Refunds & Cancellations policy applies.

We may also close accounts that have been inactive for an extended period, after giving notice to the email address on the account.

Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, liability, indemnity and governing law) continue to apply.

Disclaimers

We work hard to make Tutorio accurate, reliable and available, but we cannot promise that it will be error-free or uninterrupted, that content will always be up to date with specification changes, or that using it will produce particular grades or outcomes. Educational content and AI output are provided for study support and do not constitute professional advice. Except as expressly stated in these Terms, and to the extent permitted by law, the Service is provided "as is" without warranties of any kind.

Nothing in these Terms affects your statutory rights as a consumer, including under the Consumer Rights Act 2015.

Our liability

  1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
  2. If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for loss caused by events outside our reasonable control, or for business losses.
  3. If you are a tutor, organisation or otherwise using the Service in the course of business, our total liability to you arising out of or in connection with the Service in any 12-month period is limited to the greater of £100 and the amount you paid us in that period, and we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss of goodwill.
  4. We are not liable for content or conduct of tutors, learners, organisations or other users, or for third-party services we link to or integrate with.

Indemnity

If you are a tutor, organisation or business user, you agree to indemnify Tutorio against claims, losses and reasonable costs arising from Your Content, your breach of these Terms, or your use of the Service in breach of the law or the rights of others.

Changes to these Terms

We may update these Terms from time to time to reflect changes in the Service, the law or our business. When we make a material change we will give you reasonable notice - normally at least 14 days - by email or in-app notice before it takes effect, and we will update the version number and effective date shown on this page. Every published version is retained in the version history at the bottom of this page. If you continue using the Service after a change takes effect, you accept the updated Terms; if you do not agree, you should stop using the Service and may be entitled to a refund under our Refunds & Cancellations policy.

General

  • Entire agreement. These Terms and the incorporated policies are the whole agreement between you and Tutorio about the Service. For organisations, the Schools & Organisations Agreement and any signed order form take precedence over these Terms.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of our business, and will tell you if we do.
  • Severability. If a court finds part of these Terms unenforceable, the rest remains in force.
  • No waiver. If we do not enforce a right immediately, we can still enforce it later.
  • Third parties. Apart from Apple and Google as described in the Mobile App Licence, no one else has rights under these Terms.
  • Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control.

Governing law and disputes

These Terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland you may also rely on the mandatory consumer laws of, and bring proceedings in, your home country. The courts of England and Wales have jurisdiction over any dispute, subject to the same consumer protection.

If you have a problem, please contact us first at [email protected] - most issues can be resolved quickly. Consumers may also use the UK's alternative dispute resolution options; we will tell you which scheme, if any, we take part in when a complaint cannot be resolved.
