These Tutoring & Live Lessons Terms (the "Tutoring Terms") apply in addition to our Terms of Service whenever someone teaches, or is taught, on Tutorio. They cover the tutor workspace, classes, live lessons, assignments, reviews, screening tests, results and the communication tools between tutors and learners. If there is a conflict between these Tutoring Terms and the Terms of Service, these Tutoring Terms apply for the matters they cover.
Definitions
- Tutor - any person with tutor, staff or admin access in the tutor workspace, including teachers, tutoring agency staff and independent tutors.
- Learner - a person connected to a tutor through a class, join link, organisation or invitation.
- Class - a group of learners connected to one or more tutors, created through a join link, QR code or join code.
- Live lesson - a session in which a tutor delivers content and questions to learners in real time, sees their answers as they come in, and may reveal answers, award points, annotate and run a leaderboard or finale.
- Delivery - any content, assignment, review or test a tutor sends to learners, whether live or to complete in their own time.
- Organisation - a school, college, council, agency or other body that manages tutors and learners on Tutorio under our Schools & Organisations Agreement.
The relationship between tutors, learners and Tutorio
- Tutorio is a platform. Unless we tell you otherwise in writing, tutors are not employed, engaged or vetted by Tutorio, and Tutorio is not a party to any tutoring arrangement between a tutor (or their organisation) and a learner or parent.
- Fees for tutoring, session scheduling, cancellations of sessions and the quality of teaching are matters between the tutor or organisation and the learner or parent, unless the tutoring is a product you buy from Tutorio directly.
- Tutorio does not guarantee that any tutor holds particular qualifications, checks or insurance. Organisations are responsible for vetting their own staff. Independent tutors are responsible for meeting the requirements of the law and of the settings in which they work.
Tutor eligibility and conduct
To act as a tutor you confirm and agree that:
- You are at least 18 years old.
- Where you teach anyone under 18 or an adult at risk, you hold any checks required in your jurisdiction and setting (in England and Wales, this will normally include an appropriate Enhanced DBS check with the relevant barred list check where you are in regulated activity), and you are not barred from working with children.
- You will comply with our Safeguarding Policy, including the rules on communication with learners, and you will report concerns promptly.
- You will use the tutor workspace only to teach learners who have legitimately joined your classes, and will not add learners without the necessary authority and consent.
- You are responsible for everything you publish to learners - courses, questions, mark schemes, feedback, messages and annotations - including anything drafted, adapted or marked with the help of AI. You must review AI output before relying on it, in line with our AI Transparency Statement.
- You will keep learner data confidential, use it only for teaching and progress purposes, and will not export, share or retain it beyond what your role legitimately requires.
- You will follow the Acceptable Use Policy and Content & Community Guidelines.
Classes and join links
- Tutors can create classes and invite learners with join links, QR codes and short join codes. Anyone with a link or code can join the class, so treat them as sensitive: share them only with the intended learners and regenerate them if they leak.
- When a learner joins a class, the tutor (and their organisation's colleagues where sharing is enabled) can see the learner's display name, progress, answers, scores, notes they choose to share, screening test results and activity within that class.
- Tutors are told when a learner joins. Learners are told which tutor or organisation runs the class and can leave at any time from their class list. Tutors can remove learners at any time.
- Where a learner is under 13, or under 18 and in a school setting, the tutor or organisation must have the parental or institutional authority described in Children's Privacy & Parents before adding them.
Live lessons
- During a live lesson learners' answers, drawings on the annotation layer, response times and scores are transmitted to the tutor as they happen, and the tutor may display an anonymised or named leaderboard, reveal answers and show a summary at the end. By joining a live lesson a learner agrees to this.
- Live lesson activity is visible to the tutor and to the learner's own device. It is not broadcast to other learners except where the tutor chooses to reveal results, a leaderboard or a finale to the class.
- Tutors must use the "see every answer" and monitoring tools only for legitimate teaching and assessment.
- Live lesson notifications (including push notifications, Dynamic Island and lock-screen live activities on supported devices) are sent to learners who have joined the class and enabled notifications. Learners can disable them at any time in their device or Tutorio settings.
- Tutorio does not record audio or video of live lessons. If a tutor uses a separate video-calling tool alongside Tutorio, that tool's terms apply and any recording must comply with the law and the tutor's or organisation's own policies.
- Learners and tutors must not photograph, screen-record or otherwise capture other participants' answers, names or scores and share them outside the class.
Assignments, reviews and screening tests
- Tutors can set assignments (practice to complete by a due date) and reviews (retrieval practice covering material already taught). Learners receive reminder notifications on a reasonable schedule, which they can adjust or turn off.
- Screening tests (such as reading age or reasoning indicators) are educational indicators only. They are not clinical, diagnostic or psychometric assessments and must not be presented as such. Any decision based on them is the tutor's or organisation's responsibility.
- Results shown to tutors reflect what a learner submitted through Tutorio. Tutorio takes steps to detect and discourage cheating (see the Acceptable Use Policy) but cannot guarantee that every result reflects unaided work.
- Tutors must not use results for any purpose that has a legal or similarly significant effect on a learner without appropriate human review and, where required, the learner's or parent's knowledge.
Courses you create and share
- Courses, topics, questions and notes you create remain yours, licensed to us as described in the Terms of Service. Where you adapt Tutorio content, the underlying Tutorio content remains ours.
- If you belong to an organisation, courses you create may be visible to and editable by colleagues in that organisation according to its sharing settings, and the organisation may retain them if you leave.
- You must hold the rights to any third-party material you include. Where you include exam board questions or other copyrighted material, you are responsible for ensuring you are permitted to use it in your setting.
- Tutorio may remove or restrict content that breaches our guidelines or the law, and may de-publish courses that are reported and found to be infringing.
Learner responsibilities
As a learner in a class you agree to complete work honestly, treat tutors and other learners with respect, keep other people's answers and scores private, and follow any additional rules set by your tutor, school or organisation. Where you are under 18, your parent, guardian or school agrees to these on your behalf.
Data protection roles
- For learners who use Tutorio independently, Tutorio is the data controller of their personal data as described in our Privacy Policy.
- For learners connected to an organisation, the organisation is normally the controller of the learner data it puts into Tutorio and Tutorio acts as its processor under the Schools & Organisations Agreement.
- Independent tutors who set up their own classes are controllers of the learner data they collect and must have their own lawful basis, privacy information and (where required) ICO registration. Tutorio processes that data as their processor for the purposes of providing the Service, and as an independent controller for platform security, billing and legal compliance.
Fees and payments between tutors and learners
Tutorio does not currently take payments for tutoring sessions on behalf of tutors. Any tutoring fees are agreed and collected outside Tutorio and are solely the responsibility of the tutor or organisation and the learner or parent. Tutors may purchase plans, licences and AI credits from Tutorio in accordance with the Terms of Service and Refunds & Cancellations.
Suspension of tutor access
We may suspend or remove tutor access immediately, and notify the relevant organisation and authorities where appropriate, if we receive a credible safeguarding concern, evidence of a breach of these Tutoring Terms, or a lawful request from an authority. We will act proportionately and, where safe to do so, tell you what has happened and how to respond.
Changes
We may update these Tutoring Terms as the tutoring features evolve. Material changes will be notified to tutors and organisations at least 14 days before they take effect, and every version is kept in the version history below.
