Mobile App Licence (EULA)

The licence for the Tutorio apps on the App Store and Google Play, including the terms Apple and Google require.

  • The apps are licensed to you, not sold. The licence is personal and non-transferable.
  • The agreement is between you and Tutorio; Apple and Google are not parties, but may enforce it.
  • In-app purchases are handled by Apple or Google under their refund rules.
  • The apps use notifications, widgets, live activities and Spotlight only with your permission.
  • Do not jailbreak, reverse engineer or redistribute the apps.

This Mobile App Licence (the "EULA") applies to the Tutorio apps for iOS, iPadOS and Android (the "App") that you download from the Apple App Store or Google Play. It is between you and Tutorio Ltd and supplements our Terms of Service, which also apply to everything you do in the App. If this EULA conflicts with the Terms of Service, this EULA applies to the App software itself and the Terms of Service apply to the Service you access through it.

Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices that you own or control, for your own learning or, if you are a tutor, for teaching your learners on Tutorio, in accordance with this EULA, the Terms of Service and the usage rules of the store you downloaded it from. On Apple devices the licence also allows use through Family Sharing where the store permits it.

Restrictions

You must not: copy, modify or create derivative works of the App; reverse engineer, decompile or disassemble it except where the law expressly allows; rent, lease, sell, sublicense or redistribute it; remove or alter proprietary notices; use it on a jailbroken or rooted device in a way that circumvents its security; use it to build a competing product; or use it in breach of the Acceptable Use Policy.

Device features and permissions

The App may ask for permission to use device features. Each is optional and you can change your choice in your device settings at any time:

  • Notifications - class invitations, assignment and review reminders, live lesson alerts, streak nudges and security alerts. On supported iPhones we also use Live Activities (Dynamic Island and lock screen) during live lessons and study sessions.
  • Home-screen widgets - a glanceable view of your progress, streak and next task. Widgets are rendered on our servers from your account data and delivered to your device.
  • Spotlight (iOS) - your courses and topics can be indexed on your device so you can search for them from the home screen. The index lives on your device and is cleared when you sign out.
  • Camera - only if you choose to scan a class QR code or attach an image.
  • Haptics and sound - feedback during practice and live lessons.

The App communicates with our servers over encrypted connections and identifies your device with a random identifier so that your progress, streaks and notifications follow you. Details are in the Privacy Policy.

Updates

We may release updates to fix bugs, improve security or add features, and may require you to install an update to keep using the App. Older versions may stop working when the Service changes.

In-app purchases and subscriptions

Purchases made inside the App are processed by Apple or Google under their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your App Store or Google Play account settings. Terms required by Apple

If you downloaded the App from the Apple App Store, the following applies:

  1. Acknowledgement. This EULA is between you and Tutorio only, not Apple. Tutorio, not Apple, is solely responsible for the App and its content. This EULA may not provide usage rules that conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. The licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. Tutorio is solely responsible for providing maintenance and support. Apple has no obligation to furnish any maintenance or support services for the App.
  4. Warranty. Tutorio is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Tutorio's sole responsibility.
  5. Product claims. Tutorio, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, Tutorio, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
  7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  9. Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, your mobile data agreement).
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce it against you.

Terms required by Google

If you downloaded the App from Google Play, the Google Play Terms of Service apply to your download. Google is not a party to this EULA and has no responsibility for the App. Google may enforce this EULA as a third-party beneficiary where the Google Play Developer Distribution Agreement requires it.

Termination

This EULA continues until terminated. It ends automatically if you breach it, or if your Tutorio account is terminated under the Terms of Service. You can end it at any time by deleting the App. On termination you must stop using the App and delete all copies.

Disclaimers and liability

The disclaimers, limitations of liability and consumer protections in the Terms of Service apply to the App. Nothing in this EULA affects your statutory rights.

Governing law

This EULA is governed by the law of England and Wales, subject to any mandatory consumer protections that apply where you live.
