End-user License Agreement

1. Acknowledgement:

This Tutorio Terms of Service Agreement ("Agreement") sets forth the terms and conditions between Tutorio ("Us", "We", "Our") and You ("You", "End-User"). This Agreement is exclusively between Tutorio and You – Apple is not a party to it. Any content, rules, or usage terms set out in this Agreement are the sole responsibility of Tutorio and must not conflict with Apple Media Services Terms and Conditions.

2. License Scope:

We grant the End-User a non-transferable license to use our platform for personal learning purposes only on Apple-branded Products owned or controlled by the End-User, as permitted by Apple Media Services Terms and Conditions' Usage Rules. This license could also be accessed and used via Family Sharing or volume purchasing.

3. Maintenance and Support:

Maintenance and support services for Tutorio's services, as outlined in our Agreement, are solely our responsibility as per applicable laws. Apple is under no obligation to provide any maintenance or support services for our platform.

4. Warranties:

Any product warranties – whether implicitly or expressly mentioned, and if not disclaimed effectively - will be our responsibility. In the event of any breach of warranty, the End-User can notify Apple, who may refund the purchase fee. Beyond this refund, Apple has no further warranty obligations. All other claims stemming from any warranty failure will be Tutorio's responsibility.

5. Product Claims:

Tutorio is responsible for addressing any product claims made by the End-User or any third party relating to our platform, including but not limited to product liability claims; any claim that the platform fails to meet any legal or individual prerequisites; and issues that arise under consumer protection, privacy regulations, the use of the HealthKit and HomeKit frameworks.

6. Intellectual Property Rights:

If a third party claims that our platform infringes their intellectual property rights, we will solely manage the investigation, defense, settlement, and discharge of any intellectual property infringement claims.

7. Compliance with Laws:

You affirm that you are not located in a country that is embargoed by the U.S. Government, has been labeled a “terrorist supporting” country by the U.S. Government, or is on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms:

If you use third-party applications in conjunction with our platform, you must adhere to any applicable third-party terms of agreement (e.g., not violating wireless data service agreements if you use a VoIP application).

10. Third Party Beneficiary:

Apple and its subsidiaries are third-party beneficiaries to this Agreement. From the moment you accept the terms of this Agreement, Apple will have the right to enforce this Agreement as a third party beneficiary.
